Welcome to Specscreen Service. These Terms of Use ("Terms") constitute a legally binding agreement between you ("you" or "User") and Specscreen ("Specscreen", "we", "us", or "our") governing your access to and use of the Specscreen platform, including any related websites, applications, features, and services (collectively, the "Service").

By accessing or using the Service, you agree to be bound by these Terms. If you do not agree to these Terms, you may not access or use the Service.

Our Privacy Policy explains how we collect, use, and share information in connection with the Service. By using the Service, you also acknowledge our Privacy Policy.

If additional terms and conditions apply to specific features or services offered through Specscreen, those terms will apply in addition to these Terms. In the event of a conflict between these Terms and such additional terms, the additional terms will prevail solely with respect to the specific feature or service to which they apply.

1. Understanding the Specscreen Service

The Specscreen Service is a platform that enables users to upload, share, and explore ideas.

Users can publish ideas and interact with ideas shared by others, including by building upon, extending, questioning, or otherwise developing them.

Specscreen is designed as a collaborative environment in which ideas are intended to move freely and evolve through participation. As a result, content shared on the Service may be used, modified, and developed by other users.

2. Who can use the Specscreen Service

You must be at least 16 years old to use the Service.

By accessing or using the Service, you represent and warrant that:

  • you meet the minimum age requirement;
  • you have the legal capacity to enter into these Terms;
  • and your use of the Service does not violate any applicable law or regulation.

3. User Accounts

To access certain features of the Service, you may be required to create an account.

You agree that:

  • you will provide accurate and up-to-date information;
  • you will not impersonate any person or entity or misrepresent your identity;
  • you are responsible for maintaining the confidentiality of your account credentials;
  • and you are responsible for all activities that occur under your account.

You may sign up or log in using methods made available by Specscreen, including third-party authentication providers.

We reserve the right to suspend or terminate accounts that violate these Terms.

4. How you cannot use the Specscreen Service

You agree that you will not, and will not assist or permit others to:

  • use the Service in any way that violates applicable laws or regulations;
  • post or share content that is unlawful, harmful, abusive, deceptive, or misleading;
  • impersonate any person or entity or misrepresent your identity or authorship;
  • spam, duplicate, or artificially promote content in a deceptive or manipulative manner;
  • interfere with, disrupt, or attempt to gain unauthorized access to the Service or its systems;
  • introduce viruses, malware, or other harmful code into the Service;
  • circumvent, disable, or interfere with security features or technical protections of the Service;
  • access, scrape, extract, or collect data from the Service using automated or manual means, except as expressly authorized by Specscreen.

You may not use the Service itself for unauthorized commercial exploitation, including reselling, redistributing, or creating competing services based on the Service without our permission.

For clarity, these restrictions do not limit your ability to use, develop, or commercialize ideas shared on Specscreen, as permitted under these Terms.

We reserve the right to remove content or restrict access to the Service if you violate these Terms.

5. User Content and Ownership

The Service allows you to create, post, and share content, including ideas, text, images, videos, and other materials ("User Content").

You retain ownership of your User Content and any intellectual property rights associated with it.

However, by posting User Content on the Service, you grant to:

  • Specscreen;
  • users of the Service;
  • and third parties accessing or using User Content through the Service

a worldwide, non-exclusive, royalty-free, sublicensable, transferable, and irrevocable license to:

  • use, reproduce, and display your User Content;
  • modify, adapt, and create derivative works from your User Content;
  • distribute and make your User Content available;
  • and build upon your User Content for any purpose, including commercial purposes.

The license granted under this section applies to all User Content you submit to the Service and is not terminated by the deletion of your content or account, to the extent permitted by applicable law.

You acknowledge that Specscreen operates as an open and collaborative environment in which User Content is intended to be used, developed, and expanded upon by others.

6. Collaborative use of ideas

The Service is designed to enable collaborative idea development and participation across users.

By posting User Content, you acknowledge and agree that your ideas may be interacted with and developed by others in different ways.

In particular, you agree that:

  • other users may freely use, build upon, modify, or extend your ideas;
  • ideas may evolve into multiple versions, interpretations, or directions;
  • and similar or identical ideas may be independently created or developed by other users.

You agree that you will not assert claims against other users or Specscreen based on their use of ideas shared through the Service in accordance with these Terms.

7. Commercial use of Content

Specscreen is an open platform where ideas may be used beyond the Service.

By making User Content available on the Service, you acknowledge and agree that such content may be used by individuals, companies, and organizations for commercial or non-commercial purposes.

This use may occur without notice, attribution, or compensation to you.

Specscreen does not monitor, control, or assume responsibility for how User Content is used outside the Service.

8. Attribution and platform features

The Service may include features designed to provide visibility into the origin and development of ideas.

These features may include:

  • identification of the user who created a piece of content;
  • and structural relationships between content (such as "building on" connections).

These features are provided for informational and organizational purposes only.

Specscreen does not guarantee attribution outside the Service and does not enforce attribution obligations between users or third parties.

9. Deletion of Content

You may delete your User Content at any time through the Service, subject to any technical limitations of the platform.

However, due to the collaborative nature of the Service, you acknowledge and agree that:

  • User Content created by others based on your content may continue to exist and remain available;
  • references to your content may persist for structural, contextual, or historical purposes;
  • and the license granted under Section 5 will continue to apply to the extent permitted by applicable law.

10. Intellectual Property and Public Disclosure

The Service operates as a public platform for sharing ideas.

By submitting User Content, you acknowledge that making ideas publicly available may affect your ability to obtain or enforce intellectual property rights, including patent rights or similar protections.

You are solely responsible for determining whether to share any content on the Service and for understanding the potential consequences of public disclosure.

Specscreen may maintain records relating to the publication, visibility, and interaction history of User Content, including timestamps and user activity associated with the Service. However, such records are provided for operational purposes only and do not constitute legal certification, verification of ownership, or independent proof of intellectual property rights.

11. Artificial Intelligence and Automated Content

Specscreen may use User Content to train, develop, and improve artificial intelligence and machine learning systems.

The Service may also allow content to be generated or submitted by artificial intelligence systems or automated agents.

In connection with such content, you acknowledge that:

  • AI-generated content may not be original or unique;
  • such content may resemble existing ideas, materials, or submissions;
  • and Specscreen does not guarantee the originality, accuracy, or ownership of AI-generated content.

Any person or entity deploying automated systems on the Service is responsible for their activity and compliance with these Terms.

12. Platform Role and Content Disclaimer

Specscreen provides a platform for users to create and share content, but does not act as a publisher or curator of that content.

Specscreen operates as a neutral intermediary and does not:

  • endorse or approve User Content;
  • verify the originality, ownership, or legality of ideas;
  • or guarantee the accuracy, reliability, or usefulness of any content.

All User Content is the sole responsibility of the user who posted it.

13. No Protection or Enforcement of Rights

Specscreen is designed as an open and collaborative platform for sharing and developing ideas.

As a result, Specscreen does not guarantee:

  • exclusivity of ideas shared on the Service;
  • protection against copying, reuse, or adaptation of User Content;
  • or enforcement of intellectual property rights between users or third parties.

You acknowledge that ideas shared through the Service may be used, interpreted, or independently recreated by others.

If you believe your rights have been violated, you may contact us. However, Specscreen is not responsible for resolving disputes between users or between users and third parties relating to ownership, authorship, attribution, or use of ideas.

14. Future features and monetization

Specscreen may introduce additional features, products, or services in the future.

These may include:

  • private content, profiles, or Spaces;
  • curated selections of content;
  • subscription-based products or services;
  • monetization or revenue-sharing programs;
  • and tools or services involving artificial intelligence systems or automated participation.

Certain features or services may be subject to additional terms, conditions, or eligibility requirements.

Unless expressly stated otherwise by Specscreen in writing, you are not entitled to compensation for the use, development, or commercialization of your User Content.

Participation in any future monetization or revenue-sharing program does not create an ongoing right to compensation and may be modified, suspended, or discontinued by Specscreen at any time.

15. Termination

You may stop using the Service at any time.

Specscreen reserves the right to suspend, restrict, or terminate your access to the Service, with or without notice, if:

  • you violate these Terms;
  • your use of the Service creates risk or potential legal exposure for Specscreen or other users;
  • or we reasonably believe your conduct is harmful to the Service or its users.

Upon termination, your right to access and use the Service will immediately cease.

Sections of these Terms that by their nature should survive termination, including provisions relating to licenses, disclaimers, limitations of liability, and dispute-related matters, will remain in effect after termination.

16. Disclaimers

The Service is provided on an "as is" and "as available" basis.

To the fullest extent permitted by applicable law, Specscreen disclaims all warranties, representations, and guarantees of any kind, whether express, implied, statutory, or otherwise, including any warranties of:

  • merchantability;
  • fitness for a particular purpose;
  • non-infringement;
  • accuracy;
  • availability;
  • or reliability.

Specscreen does not guarantee that:

  • the Service will always be available, secure, or error-free;
  • User Content will be accurate, original, or reliable;
  • or ideas shared through the Service will remain confidential or protected from use by others.

Your use of the Service is at your own risk.

17. Limitation of Liability

To the fullest extent permitted by applicable law, Specscreen and its affiliates, directors, employees, partners, and service providers shall not be liable for any indirect, incidental, consequential, special, exemplary, or punitive damages arising out of or related to your use of, or inability to use, the Service.

This limitation applies regardless of the legal theory on which the claim is based and includes, without limitation, damages relating to:

  • the use or misuse of User Content by other users or third parties;
  • loss of intellectual property rights, business opportunities, goodwill, data, or revenue;
  • unauthorized access to or use of the Service;
  • or interruptions, errors, or failures in the operation of the Service.

To the fullest extent permitted by law, the total liability of Specscreen for any claim arising out of or relating to these Terms or the Service shall not exceed the greater of:

  • one hundred euros (€100);
  • or the amount you paid to Specscreen, if any, during the twelve (12) months preceding the event giving rise to the claim.

Some jurisdictions do not allow certain limitations of liability. In such cases, some of the limitations above may not apply to you.

18. Changes to these Terms

Specscreen may update or modify these Terms from time to time in order to reflect changes to the Service, legal requirements, or business operations.

If we make material changes to these Terms, we will provide notice through the Service or by other reasonable means.

Your continued access to or use of the Service after updated Terms become effective constitutes your acceptance of the revised Terms.

If you do not agree to the updated Terms, you must stop using the Service.

19. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Portugal, without regard to conflict of law principles.

Any dispute, claim, or controversy arising out of or relating to these Terms or the Service shall be subject to the exclusive jurisdiction of the competent courts of Portugal, unless otherwise required by applicable law.

20. Consumer Rights

Nothing in these Terms limits or excludes any rights you may have under applicable consumer protection laws that cannot be limited or excluded by law.

If you reside outside Portugal, you may also be entitled to certain protections under the laws of your country of residence.
